Terms of Service

These terms are an agreement between you and Brotherworks LLC ("ModDog", "we", "us"), the company that operates the ModDog Discord bot, the dashboard at app.moddogbot.com, and this website. By adding ModDog to a Discord server, or by signing in to the dashboard, you agree to them. If you do not agree, remove the bot and stop using the dashboard.

1What ModDog is

ModDog reads messages in the Discord channels it can see, decides whether each one appears to break the rules you have configured, and either raises it for your moderators to review or takes an action you have authorised. It is a triage tool. It helps your moderators find the messages worth their attention, and it does not replace them.

ModDog is not a safety service, a legal compliance service, or a guarantee that anything in particular will be caught. We do not promise that it will catch every violation, and we do not promise that everything it catches is a violation.

2Automated decisions can be wrong

Every judgment ModDog makes is produced by software, including machine learning models. Those judgments are estimates. They are not statements of fact about any person, and they are not accusations. A flag means the message resembled something you asked us to look for. It does not mean the author did anything wrong.

You agree not to present ModDog's output as a factual finding about a person, and you accept that decisions you take on the strength of that output are yours. If you turn on automatic enforcement, you are choosing to let software act without a person in the loop, and you accept the consequences of the mistakes that follow.

3Who may use ModDog

You must be old enough to hold a Discord account under Discord's own terms, and you must comply with those terms and with Discord's Developer Policy while using ModDog. You may only add ModDog to a server you own or have been authorised by the owner to configure.

4Where ModDog is offered

ModDog is offered in the United States only. We do not market it, price it, or make it available outside the United States, and we do not intend to offer it to people in other countries. Prices are quoted in US dollars only.

We do not block anyone by location, because location signals available to a Discord bot are not reliable enough to act on. Instead we reserve the right, described in section 12, to suspend or end service to any server we determine to be outside the regions we support, and we will exercise it.

5Your server, your rules

You decide what ModDog looks for and what happens when it finds something. That includes which categories are active, how sensitive each one is, what enforcement ladder applies, and whether ModDog acts on its own or only raises things for review.

You are responsible for telling the people in your server that an automated moderation tool is in use, to whatever extent the law where you and your members are requires it. You are responsible for the rules you write and the enforcement decisions you make. ModDog gives you the controls; the community is yours to run.

6Permissions you grant

ModDog asks Discord for the permissions it needs to do the job you have asked of it, including reading and managing messages, timing out, kicking and banning members, managing roles, and creating the private channel where your flags land. You can withhold or withdraw any of these in Discord at any time. Features that depend on a permission you have not granted will not work, and ModDog will tell you which ones.

7Plans, billing and refunds

ModDog has a free plan and paid plans. Current prices and message allowances are shown on the pricing section of this site and in your dashboard. Paid plans are billed monthly in advance through Stripe, and they renew until you cancel.

You can cancel at any time from the billing portal in your dashboard. Cancelling stops the next renewal and your plan continues until the end of the period you have already paid for. We do not give partial refunds for time you have not used, except where the law requires it or where we have made a billing error.

If a free server exhausts its monthly allowance, ModDog keeps applying its rule-based protection and stops making fresh model judgments until the allowance resets. Protection does not stop; only the part of it that costs us money to run pauses.

We may change prices. If a price changes for a plan you are on, we will tell you before it takes effect, and you can cancel before it does.

8Acceptable use

Do not use ModDog to break the law, to break Discord's terms, to harass anyone, or to build a record about a person for a purpose unrelated to moderating your community. Do not attempt to extract our models, reverse engineer the service, or interfere with its operation. Do not resell access without our written agreement.

9Your data and your members' data

How we handle data is set out in the Privacy Policy, which forms part of these terms. In short: ModDog classifies messages as they arrive and does not keep your chat history, what it does keep is encrypted at rest, and we never use your community's messages to train models.

10Encryption, and what happens if a key is lost

Your settings, your audit log, and anything waiting in your moderation queue are encrypted at rest. If the encryption key protecting your data is lost or destroyed, that data is unrecoverable. There is no recovery path, no backdoor, and no support process that can restore it, because a system that could do that would not be encrypted in any meaningful sense. This is a deliberate trade and you should understand it before you rely on the audit log as a record.

11Availability and changes

ModDog is a live service that we change. We add features, remove features that are not working, and take the service down for maintenance. We do not promise any particular level of uptime, and we do not promise that a feature you use today will exist tomorrow. Where a change materially reduces what a paid plan does, we will tell paying customers before it lands.

12Suspension and termination

You can stop at any time by removing ModDog from your server. When you do, we mark your stored data for deletion after a short grace period, so that an accidental removal followed by a re-add loses nothing.

We may suspend or end service to a server, with or without notice, if it is being used to break these terms or the law, if it puts the service or other customers at risk, if payment fails and is not resolved, or if we determine the server is outside the regions in which we offer service.

13Disclaimers

ModDog is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error free, or that its judgments will be accurate.

14Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of your use of ModDog, whether or not we were told such damages were possible.

Our total liability for any claim relating to ModDog is limited to the greater of one hundred US dollars or the amount you paid us in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow these limits. Where that is so, they apply to the maximum extent permitted.

15Indemnification

You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising out of your use of ModDog, the rules you configured, the enforcement decisions you or your moderators made, or your breach of these terms.

16Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Culpeper County, Virginia, and you consent to their jurisdiction.

17Changes to these terms

We may update these terms. When we do, we will change the date at the top, and for material changes we will notify account holders through the dashboard before they take effect. Continuing to use ModDog after a change means you accept the updated terms.
